General
Georgian Airways reserves the right to make all changes to this Web site at its
sole discretion without notice to the customer. Georgian Airways reserves the
right to, at its sole discretion, deny access to this Web site to anyone at
anytime.
These Terms refer only to the use of this Web site and separate terms and
conditions apply to airline carriage and other services.
This Agreement shall be deemed to have
been made in Tbilisi, Georgia, and shall be interpreted, and the rights and
liabilities of the parties hereto determined in accordance with the law of
Georgia, without regard to conflicts of law principles. The parties consent to
the exclusive jurisdiction of the courts of Georgia for the determination of
any claim or controversy between the parties and arising out of or relating to
this Agreement.
User acknowledges that no joint venture, partnership,
employment, or agency relationship exists or arises between the User and
Georgian Airways as a result of this Agreement or use of this Web site. User
agrees not to hold himself or herself out as a representative, agent, or
employee of Georgian Airways and that Georgian Airways will not be liable for
any representation, act or omission of the User.
Georgian Airways's performance of this Agreement is
subject to existing laws.
If any part of this Agreement is determined to be
invalid or unenforceable pursuant to applicable law including, but not limited
to, the warranty disclaimers and liability limitations set forth above, then
the invalid or unenforceable provision will be deemed superseded by a valid,
enforceable provision that most closely matches the intent of the original
provision and the remainder of the Agreement shall continue in effect.
This Agreement constitutes the entire agreement
between the User and Georgian Airways with respect to this Web site and the
services offered thereon and it supersedes all prior communications and
proposals, whether electronic, oral or written, between the User and Georgian
Airways with respect to this Web site. A printed version of this Agreement and
of any notice given in electronic form will be admissible in judicial or
administrative proceedings based upon or relating to this Agreement to the same
extent and subject to the same conditions as other documents and records
originally generated and maintained in printed form.
Intellectual Property Rights
All trade marks, copyright, database rights and other intellectual property
rights in the materials on this Web site belong to Georgian Airways and/ or its
licensors. No material from this Web site may be copied, modified, altered,
reproduced, republished, uploaded, posted, transmitted, sold or distributed in
any way, without the prior written permission of Georgian Airways, unless
explicitly stated otherwise or provided by law.
Use of Reservations
Customer warrants that he or she is at least 18 years of age and possesses the
legal authority to enter into this Agreement and to use this Web site in
accordance with all the terms and conditions herein. Customer agrees to be
financially responsible for all use of this Web site (as well as for use of
customer's account by others, including without limitation minors living with
customer). Customer agrees to supervise all usage by minors of this Web
site under customer's name or account, provided that customer hereby agrees to
pay all charges that they incur and to be responsible for all other aspects of
their usage. Customer warrants that all information supplied by him or members
of his household in using the Web site is true and accurate.
The reservation features of this Web site are provided
solely to assist customers to determine the availability of travel-related
goods and services and to make legitimate reservations. Without limitation, any
speculative, false or fraudulent reservation or any reservation in anticipation
of demand is prohibited. Customer agrees that the travel services reservations
facilities of this Web site shall be used only to make legitimate reservations
or purchases for customer or for another person for whom customer is legally
authorized to act. Customer shall be completely responsible for all charges,
fees, duties, taxes and assessments arising out of the use of this Web
